User conditions
Purpose
This document contains the Terms of Use that bind two parties. These Terms of Use establish a contractual relationship between:
AGILE THINKING and its training network, hereinafter referred to as AGILE THINKING, whose website can be found at https://www.agilethinking.pro, on the one hand;
And the client, on the other hand, whether an individual, a company, an organization, or any other entity that agrees to pay for the services provided by AGILE THINKING.
Service Offer
AGILE THINKING provides a range of training offers, each detailed in the corresponding descriptions and communicated through various channels, such as its website https://www.agilethinking.pro and its partners’ websites, including but not limited to https://www.scrum.org/classes?uid=224121 and http://www.agile.cm.
AGILE THINKING also offers consulting and coaching services.
Trainer Availability
AGILE THINKING will use commercially reasonable efforts to provide qualified trainers according to the schedule and commitments made in the training plan, or to assign an available trainer from its network.
To maintain our agile operations, we may occasionally reschedule training sessions or provide alternate trainers.
We continuously strive to improve our services and outcomes, and we welcome your feedback to help us achieve this.
Payment Terms
Payments are due to AGILE THINKING.
AGILE THINKING reserves the right to apply interest on any overdue payments in accordance with applicable regulations.
All prices are exclusive of taxes and intended only for companies operating within Cameroon.
Prices are subject to change.
Local Taxes and Obligations
The client is responsible for any local taxes or obligations resulting from our work.
Any taxes or obligations imposed by jurisdictions other than those in which AGILE THINKING maintains offices shall be borne by the client, in addition to the fees stated in this service offer.
Limitation of Liability
Under no circumstances shall AGILE THINKING be held liable for any direct or indirect damages, including but not limited to loss of profits, even if we have been advised of the possibility of such damages.
AGILE THINKING’s liability, regardless of cause, shall be limited to the total amount paid by the client and received by AGILE THINKING.
Cancellation and Expiration
If you cancel a class or any seats within two weeks prior to a training session, your seats will simply be transferred—at our discretion—to the next available course.
Purchased seats cannot be used for training sessions scheduled more than one year after the payment date.
Force Majeure
Neither party shall be held responsible for any failure or delay in the performance of this agreement during a period in which such failure or delay results from causes beyond their control, including but not limited to natural disasters, wars, strikes or labor disputes, embargoes, government orders, or any other event of force majeure.
Publicity
We are often asked to provide examples during our training sessions, either in public materials or in-class discussions.
You agree that AGILE THINKING and its personnel may refer to the fact that we were engaged by you and may provide a general description of the nature of our work, the challenges addressed, and the results achieved.
Unless otherwise notified by you, you agree that we may use your name and logo in this context.
Changes to the Terms of Use
AGILE THINKING reserves the right to modify these Terms of Use at any time.
Governing Law
This agreement is governed by the laws of the territory indicated in the training offer, such as France or Cameroon.
